Hello Edmontonian, I came to Edmonton in August to finalize my PR. I have just got my first PR card, and I am also very happy that I caught the summer in Edmonton. I like it!
Back in August, since I was not sure how long I would stay here, I signed a short-term lease with a landlord for three months, from Sept 1st to Nov 30th, and the place written on the lease is address A.
The place was supposed to be ready by Sept 1st but it was not. There was some renovation work going on. I was then assigned to address B, which is another property of the same landlord. I was told place A would be available on Oct 1st. But on Oct 1st it's still not ready, because the work needs even more time. Actually as of today the work is still not finished. It looks indefinite.
At last, I l have lived in address B for almost two months (Sept 1st - Oct 27th).
I carefully read the lease. It does not say anything about alternative accommodation in case the intended address is not available for any reason.
Now I decided to move out by Oct 31 and find myself another place. I really don't like B because it's on the street and noisy (97 St north of Kingsway, multiple car accidents recently if you have heard). The point is, at the beginning I picked place A for its more convenient location and its being quiet.
Anyway, here is the disagreement. I have paid 2 months' rent plus 1 month's deposit. The landlord said I still own her one month's rent for Nov. The landlord threatened to file to court if I don't pay. I honestly don't agree because I was not given the place originally written on the lease, and I even think she should return (at least part of) the deposit. It's not a lot of money. But I feel I was treated disrespectfully.
I don't know very well the tenant-landlord rules here. So, simple questions,
(1) Do I really own the 3rd month's rent to the landlord?
(2) Am I in a position to ask for the deposit? I mean ask for it to be considered as it normally be (deduct property damage et. al.), or the landlord has the right to keep it all?
Thanks for reading this!
Edit1: Some comments enlightened me about the deposit. Since no move in inspection was performed for either place, it seems I am in a position to ask for returning the deposit in full. This is probably independent from the landlord's argument about the 3rd month's rent.
