POLICY BREAKING: The DOJ Asks Washington State To Set Aside Ballots From 405 Alleged “Noncitizens” Ahead Of The Midterms, As Its Secretary Of State, Steve Hobbs, Questions The List’s Accuracy And Warns That Eligible Citizens Could Be Wrongly Flagged 🏛️
Federal prosecutors asked Washington Secretary of State Steve Hobbs to set aside ballots from 405 registered voters whom the Justice Department believes are not U.S. citizens until their citizenship can be verified. Acting U.S. Attorney Neil Floyd said many are believed to be green card holders and estimated that more than 1,500 ballots had been illegally cast across multiple elections, calling the findings “the tip of the iceberg.” Those figures remain the prosecutors’ allegations, not established court findings. Hobbs confirmed receiving the request but questioned the records’ accuracy, noting that one dates to 1994 and warning that the verification system can mistakenly flag legitimate citizens.
Floyd said the Department of Homeland Security compared a publicly available voter list with government information, followed by additional investigation into voting histories. Washington had previously refused DOJ’s demand for its complete, unredacted voter rolls, which include sensitive identifying information, and a federal judge dismissed the administration’s lawsuit seeking those records last month. Hobbs said his office would respond only to requests that follow due process and accused DOJ of creating unfounded suspicion just one week before the election. Noncitizen voting is illegal and rare, according to the report, but whether the people on this particular list are ineligible remains disputed.
The request follows a similar DOJ effort in California, where the administration sought to prevent the counting of mail ballots associated with approximately 20,000 suspected noncitizens pending verification. An appeals court rejected its emergency intervention Monday night, with a district court hearing scheduled for Tuesday. In Washington, DOJ has so far sent a letter rather than filed a lawsuit to compel ballot separation. The immediate dispute concerns whether the government’s evidence justifies setting ballots aside without putting eligible voters’ rights at risk.
