what happens if someone hits ur car and has no insurance?

• Upvotes

so yea it really depends on what kind of coverage u have, in california ur uninsured motorist coverage may help pay for ur injuries if the other driver has no insurance, it all depends on ur policy andd how much coverage u have it usually wont cover damage to ur car tho.

as for your car repair if u have collision coverage that can help cover the cost but usually have to pay ur deduction

honestly its a good idea to check ur policy beforehand just so u know what you're dealing with u really don't wanna be stuck figuring all this stuff out after an accident happens

Attorney Fees and Costs

• Upvotes

Utah. Asking for a “friend”. My friend is in the middle of a dispute in small claims court. Assuming they prevail in court, would it be a bad move to ask the court to order the defendant to pay for the AI subscription they used to draft all pleadings and do the legal legwork in lieu of an actual attorney?

Edit: obviously, my friend is the plaintiff and I refer to them as “they” so that I do not inadvertently give away their identity.

If you ask me, I think my friend is unhinged and I’ve already offered my advice: if you do win, STFU and walk away with your prize. But they correctly pointed out I’m no lawyer. So now I’m on a quest to prove I’m mostly likely to be correct.

What says the legal professionals?

Mip in San Bernardino at a rave

-NOT ASKING FOR LEGAL ADVICE!! I want to know if anyone has experienced this as well especially at a rave in San Bernardino California since when it happened to me I saw multiple ppl detained too.

To put it short I went to a rave back in September and my 2 friends snuck in their OWN alc location: San Bernardino. for some reason one of my friends couldn’t take it out of her boot and asked me to help her and there my dumba$$ went to get it for her. Once I had it in my hand an undercover cop came up to me and asked me how old I was bc I looked young. Since he was undercover I assumed he was trying to hit on me bc he was laughing and smiling. I was with my BF so I ignored him and said “I’m good” after that he showed me his badge and detained me and my boyfriend because my other friend handed him the alc since she was taking out multiple bottles and asked him to hold them. (Small shooter bottles) the cop tells me “i saw u take it out of her boot” ends up writing me a citation along w my bf. It’s been 2 almost months since and I haven’t recived anything . I check the website and try calling the court but no one ever answers. Is this something I can fight? I have the money for an attorney or can I get a public defender if I eventually have to show up in court? I truly don’t want this on my record I’m in the process of going to nursing school , 4.0 gpa , clean record and I don’t even drink it was my first ever rave. I just wanna know if anyone has dealt with something like this in San Bernardino because ik the nos center always hosts raves help a girl out 😩😩
ALSO I am not from San Bernardino I live an hour away in the antelope valley so I’m not familiar with how strict the county is

What counts as emotional distress damages in a sexual assault case in California when there's no receipt for it?

• Upvotes

I keep seeing emotional distress mentioned as part of the damages but I don't understand how it's measured. There's no receipt for it. I've been in therapy, I've missed work, I have trouble sleeping and I don't go out the way I used to. Do those things count, or does it have to be a diagnosis? My therapist says it's improving but my boss has noticed I'm distracted. I keep thinking that if I can't prove it, it doesn't count.

Extenuating circumstances for lawyers

Location: New York

Hi,

I am a young adult considering law school. There is a lot about the profession that seems very appealing to me, and I think I have the skill set to be a decent lawyer. I have started studying the LSAT and will explore the application process for next year's cycle. As this decision has lived in the back of my mind over the last few months, I keep wondering how lawyers deal with life circumstances that take them off of their game, or other unexpected challenges in life.

For example, I have severe celiac disease. I am very careful with my health, but sometimes things happen by accident or in ways that feel out of may control, and when I get glutened, I experience very intense Brian fog for a few days. When this happened to me recently, I thought "what the hell would I do if this were to happen to me with a trial starting the next day?" There are plenty of other circumstances like that, but you get my point.

Just really curious, what is the culture around that in the law community? Are lawyers wrapping themselves in bubble wrap in the lead up to important dates, or are courts lenient to rescheduling things when the person requesting the accommodation is counsel?

Just really curious about this aspect of the career as I contemplate it. Would love to hear lawyers' thoughts and experiences. Thank you!

Colorado Prop 135

Will prop 135 in Colorado prevent legal adults over the age of 18 from using their private health insurance for gender reassignment surgery deemed medically necessary by a healthcare professional? It seems certain that it will ban minors from doing so however the wording is unclear to me whether adults will be affected. It seems like it should be illegal for the government to restrict what you can use your private health insurance for in that way.

Any Montana lawyers here dealt with aggravated DUI cases?

Just curious if any attorneys here have dealt with aggravated DUI cases in Montana, especially second offenses.

Have you seen charges get reduced to a regular DUI or reckless driving? Or even dismissed? Do most of these cases end up with a plea deal, or do some actually go to trial?

Also wondering what kind of sentences you've seen people get, like actual jail time, fines, probation, or SCRAM.

I'm more interested in how these cases really turn out in Montana courts rather than just what the law says the penalties are.

Need advice asap please!!

I live in a two-bedroom apartment in Pennsylvania where only one room has a window, and I've discovered mold and mold mites throughout the unit, including in the vents. I first noticed the mold in August, although it likely existed before then. Despite documenting the problem with photos, emails, and text messages, my landlord has taken until October to begin forming a plan to address it. Between August and now, they only attempted superficial fixes, stopped answering my calls, and removed maintenance reports from the portal. They have threatened to have me move out with only 40 days' notice but later said I could stay while they gut the affected room. What are my rights in this situation, and what steps should I take to ensure my living conditions are safe and my rights as a tenant are protected?

Prosecutors. How do you deal with racial bias *against* the defendant?

General question but I was raised in NY, currently in TX.

Say a black defendant is accused of a crime, or malice, and suffers racist scrutiny that has absolutely nothing to do with what they’re being accused of. From people who would be raring to defend them if they were white. (Cough) Karmelo (Cough)

Incredibly disgusting to see that happen.

Say you truly believe they did it, or did it with malice. How do you deal with the implications of a guilty verdict? Would systemic racism in the proceedings bother you? How do you prevent it from occurring? What lengths do you go. Are you willing to weaken your argument if it ensures a guilt verdict is based on fact and not bias?

Do you ever worry that the Jury cared more about the defendant’s race than what they’re being accused of? Do you worry a jury’s judgment is clouded by bias?

Have you gone out of your way to eliminate bias to clear your conscience from a possible malicious guilty verdict? To remove the possibility of an appeal on the grounds of bias, even if true, documented cases of bias are ignored by the same racist system?

Have you had colleagues rely on it just to make their lives easier? Where are they now?

I hear OJ's prosecutors specifically sought out a black jury from an LA community that didn’t trust the LAPD to avoid the appearance of bias, since white juries didn’t sit right with them. It backfired on them, the jury acquitted on reasonable doubt, and the controversy motivated certain systems to boguard black jurors even harder. IDK if links are allowed but I can find the source if you need, it’s an interview with OJ’s defense attorney

What does it mean if someone gets deferred adjudication for SA of a child and possession of child pornography in Tarrant County Texas?

A friend of my brother’s was arrested almost two years ago for sex crimes, which shocked everyone who knew them. I recently got curious about what happened with the case, and after some back and forth with the county clerk, I finally obtained the court records.

Turns out they received six years of deferred adjudication last year. The child sexual assault and possession of child pornography charges were waived as part of the plea agreement, and they pleaded guilty to lesser charges. They also don’t appear to have been required to register as a sex offender and won’t serve prison time as long as they successfully complete their supervision.

I’m honestly pretty shocked by how lenient the outcome seems, especially considering this happened in Texas.

For anyone familiar with the Texas court system, is this a fairly normal outcome in cases involving sexual offenses against minors? Does deferred adjudication usually suggest there were problems with the evidence, or do prosecutors commonly offer these kinds of plea deals even when they have a strong case?

GA Jury Duty and HIPAA

When the judge asks if you know anyone (legal counsel or defendant), and they are a patient at your office (dental), is it a HIPAA violation to say yes since they will ask how you know them?

Repo metal roof legal?

I'm in Oklahoma. There is a metal roof company in my area that did a bunch of work and didn't pay their vendors and suppliers. The suppliers put leins on homes when the owners actually paid the company, but the company didn't pay their own bills. Can they repo it? Is this a real thing? If I take my car to a mechanic and he puts a bunch of parts on my car and then he doesn't pay AutoZone, could someone come take my car parts off my car or put a lien in my car? I'm just bewildered how the homeowner could be on the hook when they paid everything that they were supposed to. And on a side note, how would they even know that it's going on my roof? How would the supplier get their address like that?

Credit/rebate to someone other than purchaser

Texas. The stone countertop industry for years was strictly wholesale > retail > consumer/homeowner. Wholesalers wouldn’t sell, or even talk pricing, to the homeowner. Recently there have been retailers that don’t manage their business/money well or are individuals that don’t want to take credit cards that are asking wholesale to charge homeowners directly, at a marked up price, and get the difference credited back to the retailer without telling the homeowner. Is this a legal practice?

Usually they just want store credit, but some ask for a check if that changes anything.

Bumped into pedestrian in car, pedestrian fell on butt, refused help, or medical attention, then walked away. Should I report to police? To my job?

Im in Oregon and recently experienced a small pedestrian collision while driving a COMPANY vehicle. I’m extremely shaken up and looking for some general information about the possible legal consequences.
I was stopped at a red light preparing to make a right turn on red. As I began moving forward at approximately 1–2 mph while still looking left for oncoming traffic and the front of my vehicle made contact with an elderly female pedestrian near her hip, causing her to lose her balance and fall onto her buttocks.
I immediately stopped, got out, and checked on her. She was crying and understandably upset, but was responsive and able to communicate. I asked whether she was injured, whether she could walk, and whether she needed medical attention or wanted me to call someone.
She declined medical assistance and told me she thought she might just have a bruise. I helped her stand up and watched her finish crossing the street and continue walking independently.
Other motorists also stopped to check on her. I talked to one who asked what happened and I told him exactly what went down and said she seems to be ok. After she had walked away, I returned to my vehicle and left the area.
Unfortunately, I was extremely flustered and traffic was backing up. I did not exchange contact or insurance information with her, and I didn’t obtain any witness information. I also don’t know the exact intersection where this happened since I was flustered and didn’t think to look around.
I’m concerned about the legal ramifications, especially since I was driving a company vehicle.
My questions are:
Under Oregon law, could leaving without exchanging information constitute failure to perform the duties of a driver, even though I stopped, assisted her, and waited until she walked away?
Does the pedestrian declining medical assistance have any legal significance?
Could I personally face legal consequences, or would a potential injury claim generally be handled through my employer’s vehicle insurance?
What steps are required to properly report an incident like this when the pedestrian’s identity and exact location are unknown?
Is there anything I SHOULD do asap? I think there’s a low chance she reports me as she didn’t seem to have any intention but there’s still that small chance and I didn’t think to exchange info due to how scared I was in the moment and now she’s gone.

Is it worth filing a formal police misconduct complaint after settling a §1983 lawsuit?

I recently settled a §1983 lawsuit against a police officer involving a wrongful arrest and subsequent searches authorized by allegedly deceptive warrant affidavits. I represented myself pro se and received a $75K settlement before we had even begun exchanging substantive discovery.

I believe my claims were strong largely because they involved direct contradictions between what the officer wrote in his reports and warrant affidavits and what the body-camera footage actually showed. The officer also repeatedly represented that surveillance footage had not yet been obtained, despite having obtained and reviewed footage that materially undermined the case against me.

Now that the lawsuit is over, I'm wondering whether it's worth filing formal complaints with the police department.

The officer is already on the Brady list, and beyond the constitutional violations alleged in my lawsuit, there are numerous apparent departmental policy violations that I believe are well documented.

My federal lawsuit will remain part of the public record, but the filings themselves are relatively bare-bones and don't capture much of the underlying misconduct.

I've also seen enough of this department's internal investigations to have very little confidence that a complaint would result in meaningful discipline. But I'm wondering whether creating a formal record of these incidents might be useful to someone in the future.

Is there any practical value in filing a formal complaint after a civil rights lawsuit has already been settled? Could that complaint record help future defendants, litigants, or anyone else dealing with the same officer?

Is there a lawsuit in California for sexual assault by a supervisor if HR calls it a personal matter?

At a company offsite last fall, my supervisor assaulted me. I reported it to HR within a week. They told me it was a "personal matter between two adults" that happened outside of work hours, even though it was a company event with a company paid hotel. I'm still working there because I need the income. He still manages my team. I've started looking for other jobs, but meanwhile I'm trying to figure out whether the company has any responsibility for how it handled this, or whether HR is right that it's not their business. I know I'm not saying much. I just can't write out all of it. I do have the HR email thread saved, and two coworkers who were there know something happened, though neither has said anything formally. Nobody has told me whether anything was actually investigated.

Mediation different if you're self-represented?

I'm defending myself pro se in a civil case involving an easement against a wealthy couple. The judge has ordered mediation, and there's also a settlement conference. My question is whether mediators/judges view things differently when it comes to settlement and pro se litigants.

My, I guess, worry is that a mediator may pressure me more than they would if I was represented by an attorney NOT because my case is weaker, but because they think I'm the easier person to get to agree to a compromise.

Is that an actual dynamic, or am I worrying over nothing? Are there other dynamics in mediation to consider as a pro se defendant?

What does a victim advocate at a law firm do, is it a real job or a marketing word?

I see it listed on a few firm websites and I can't tell if it's a real job or a marketing word. Is it someone who sits in on meetings with you, or more of a case manager?

Is a dog bite lawyer in Los Angeles overkill when my neighbor's dog bit my 7 year old and they say it never has before?

My neighbor's dog bit my 7 year old on the arm yesterday. We went to urgent care, it needed stitches, and the doctor said it'll scar. The neighbor keeps saying the dog has never done that before and that my son probably startled him. We've been friends with these people for years. I don't want to blow up the relationship, but I also don't want to get stuck with all the bills, especially since there may be follow up for the scarring. I have no idea how this works. Is it homeowner's insurance or the neighbor personally? He's okay but now scared of dogs, including ours. The neighbor offered to "split the urgent care bill" which feels off to me, like it's meant to end the conversation. I haven't signed or agreed to anything.

Florida urgent advice assistance

URGENT:

I have been working since I was 12 alone without my family and now I see criminals are trying to take it from me: old past tenant squatter, the HOA is taking more money they supposed forcing me to sell and the hard money lender taking more money set rate 10.99% to 18% who wants to foreclose.

They won't get what they want

THEY GOT THE WRONG LATINA!!

I DONT HAVE MONEY BUT I AM A STRONG BELIEVER IN JUSTICE !!

I am a Florida property owner facing an emergency housing and foreclosure crisis.

My former tenant allegedly reentered my property after contrac ended and after he returned the keys. This is everyones worst nightmare not being able to enter your home!

I filed an eviction action about a month ago but have received update. My income was the rental but I was not able to collect it for four months now and have only $300 left on my account.

On top of that I lost the sell on September 30th for $305k that I would have be able to pay the debt.

My private lender has allegedly increased my interest rate from approximately 10.99% to 18% without my agreement, and I dispute additional charges.

I was paying $500 on water that was not even mine!?!? I can't cut their power nor the water?!?!

On top of that my HOA is taking money $3,000 without notifying me without my approval and telling me "if cant afford you should sell it to us"! Of course that was what they wanted.

The squatter is planning to keep rental free power water that I dont have money to pay he has a lawyer how is that even legal or possible?!?

Squatter cost me the sale!!!! I lost $305k was selling to pay my debt.

I already paid an the last money that I had $3,500 and he didn't do anything. Can't afford to pay the bills nor home car insurance. I am covered with food thanks God!!!

Already called probobo florida bar but everyone have to pay money that I dont have first before even read my case

I need help accessing to my property and fighting with lender from foreclosure, disputing the loan charges, and getting my money from the HOA.

I cannot afford another substantial retainer.

emergency referrals or a plan that we can do no se como y dividen las ganancias como se dice???

Even the squatter has a representation how is this even possible or legal the same person that a few months ago was crying "sorry can't afford the rent nor pay deposit don't have a car" he had another eviction in Texas in July of this year.

I have called and emailed many time to the lender and the hoa but they are ignoring me.

I need justice to be made.

I believe sending a couple emails would scare them. I know what to do but because I am not a

Does a childhood sexual abuse claim against a public entity in California work differently, like a public school decades ago?

Something happened to me at a public school in LA County in the late 90s. I'm in my forties now and have been in therapy for a few years working through it. I recently learned that claims against public entities have different rules than claims against private organizations, shorter deadlines or special paperwork, I don't really know. I don't know if there's any chance I'm too late. I also don't know whether it matters that the district may have known about the person even back then. I don't want to get my hopes up, but I don't want to assume it's too late either. My therapist suggested I look into it but said she can't give legal advice, which makes sense. My old school records are in a box at my mom's house that I haven't opened.

urgent: need free legal help before my november 4 landlord-tenant hearing (Philly)

hi everyone, i’m looking for a free lawyer or legal aid organization to help me with a landlord-tenant lawsuit in philadelphia. my former landlord is claiming approximately $6,500 in unpaid rent, late fees, attorney fees, and utilities, but i believe the rent portion conflicts with a written agreement i made with the property manager.
on september 30, the property manager confirmed in writing that the landlord would waive my outstanding rent if i paid the outstanding utilities and moved out by october 6. i confirmed the agreement that same day and specifically asked if the outstanding utilities were all i needed to pay. he said yes.
the landlord filed the lawsuit on october 1, just one day after that agreement was made. on october 6, i paid the requested $232.02, returned my keys, and received written confirmation from the property manager acknowledging both. despite this, the lawsuit still includes the rent the landlord had agreed to waive.
i have screenshots of the agreement and conversations, proof of payment, and the court complaint. i’ve tried contacting the philly tenant hotline but haven’t been able to get through to someone who can help.
my hearing is november 4, and i’m trying to find legal assistance before november 3. i cannot afford a private attorney, so i’m specifically looking for free legal aid, a pro bono tenant lawyer, or an organization that can review my agreement and potentially represent me in court.
if anyone knows of a legitimate resource or attorney who handles philadelphia landlord-tenant cases, i’d really appreciate the help. thank you!
