Community Know Your Rights: The "Smile & Nod" Guide to Defeating Landlord Bullying, Illegal Showings, and May 2027 Lease Scams

Disclaimer: this is mostly AI written but all the contents are correct. I cannot be bothered to write this manually at almost midnight. Please note that this information is only accurate for non-boarder situations (where you do NOT share a bathroom or kitchen with your landlord or their spouse, child, or parent) and housing not owned by the university (dorms, John Orr, An Clachan, etc.) or housing co-ops. This is legal information but not legal advice. Consult Queen's Legal Aid if you need help.

Hey everyone,

With housing season spinning up, a ton of landlords are already pulling illegal tactics on student renters, forcing pre-dated eviction forms, running unannounced showings for May 2027 leases, or treating tenants like "boarders" to bypass the law. This is the norm in Kingston because students often don't know their tenant rights but just because something is normal does not make it legal.

If your landlord is currently trying to rent out your room or house without your consent, you hold all the legal cards. Here is a breakdown of how Ontario’s Residential Tenancies Act, 2006 (RTA) actually protects you, and how you can fight back simply by staying quiet and signing nothing.

  1. Document EVERYTHING. Take photos of your house, start a Google drive with your lease, photos of the state of your house when you moved in, every incident like an unannounced showing. Canada is one party recording consent, record your landlord pulling crazy bullshit (hidden recording devices may not be legal). You do not have to inform your landlord of the law. The only way they can really hurt you if you know your rights is psychological warfare. Do not engage. Just let them break the law and document it. Kingston landlords and rental agents have the unfortunate tendancy to pressure you into signing leases for next May or September in October and November, but this is psychological warfare and there's usually places available closer to May (often with more reasonable landlords).

🛑 1. Your Lease NEVER Just Ends (The Month-to-Month Shield)

  • The Law: Under RTA Section 38(1), expired fixed-term leases automatically renew as monthly tenancies under the same terms.
  • The Reality: You do not need to sign a renewal, and landlords cannot force you out just because a student term ends.
  • The Trap: Do not sign a Form N11 (Agreement to End Tenancy), which forfeits your rights. Without it, eviction requires a formal Landlord and Tenant Board (LTB) process.

🚫 2. Showings for Next Year Are Currently ILLEGAL

  • The Law: RTA Section 26(3) permits entry without written notice for showings only if an agreement or notice to terminate the tenancy has already been issued.
  • The Reality: Without a valid termination notice or agreement (Form N9/N11), showings to prospective tenants (not buyers) are illegal. If you rent on a joint whole-house lease, they cannot enter the house for tenant showings at all. If your lease is only for an individual bedroom, they can only enter YOUR bedroom for a showing if YOUR specific lease has a termination notice/agreement. If your landlord threatens to sell the house or actually sells, your lease just transfer to the new owner.
  • The Trap: Using 24-hour notice under Section 27 for unauthorized reasons breaches your reasonable enjoyment.

📄 3. The "Pre-Dated Form" Trick is Void

  • The Law: RTA Section 37(5) dictates that any termination agreement signed simultaneously with the initial lease as a condition of entry is completely void and will be rejected by the LTB.

🚪 4. The "Boarder" and "Common Area" Loopholes Are Dead

  • The Reality: Tenancy status is locked in at the start (Cowie v. Bindlish). Landlords cannot strip RTA protections mid-lease under Section 5(i) by moving people in. If your group rents the whole house on one joint lease, the landlord cannot claim hallways or kitchens are 'common areas' to enter without 24-hour notice. Even if you rent by the bedroom (where the landlord CAN enter shared kitchens/hallways for maintenance and cleaning), using that access to harass you or make your life difficult is illegal under RTA Sections 22 and 23. Record them and log it!"

⚡ 5. Why the Slow LTB Backlog Actually Protects YOU

  • The Shield: RTA Section 39 prevents landlords from recovering possession without a formal LTB eviction order. Only the Sheriff can enforce an eviction, meaning premature new leases leave landlords exposed to liability and breach-of-contract claims.

🛠️ The Student Playbook: Watch, Nod, Smile, and Document

  • Keep bedroom doors locked against unauthorized entry (note that you cannot install a lock without notice/consent)
  • Stay vague about your future plans rather than committing in writing.
  • Log all violations; note that if a landlord fails to provide a signed copy of your lease within 21 days (RTA s. 12), or fails to provide an Ontario Standard Lease within 21 and 30 days after you demand one in writing (RTA s. 12.1), specific rent suspension and withholding rules apply.
  • Contact the Rental Housing Enforcement Unit (1-888-772-9277) for emergencies like illegal lockouts or utility shutoffs.

Know your rights, protect your space, and don't let bad-faith landlords bully you into a housing crisis!

Community Looking for roommates!

Hi everyone! My roommate and I are both second years and split off from our previous group, so we’re looking for a couple new roommates to get a 3-4 bedroom together. We’re both guys in math and stats and we’re pretty chill but don’t mind someone who’s more outgoing or shy, just as long as we aren’t hosting parties that’ll leave the place trashed. Otherwise super flexible, we’re just glad to meet new people and have someone else to live with. Dm me if you’re interested!

Does anyone know how often the libraries at Queen's University are cleaned?

I'm particularly interested in Stauffer Library. Does anyone know the regular cleaning schedule, such as which days and times the floors, desks, and study areas are cleaned?

I’m stressing a little over the SOCY 100 midterm — it’s 35% of final grade. Does anyone who’s taken it before have any good study tips, things to focus on, or what to watch out for? Any advice would be so helpful, thanks a lot!

Discussion Exam Flagged

This is my second year of online evaluations and my exams keep getting flagged for “not following instructions”. I know it’s a warning and they don’t actually do anything but it’s just very frustrating when you DO follow pre scan and post exam instructions (rip up paper on camera) at this point I’m gonna accept it as standard to get one of these emails after every exam.

The other thing that frustrates me is proctor u always wants your pre scan done then you have to LOGIN using your Authenticator which is my phone which prompts me to have to do a full pre scan all over again once I put my phone in another room.

Just my gripe of the day.

Question How strict is the no guest policy on West Campus?

I know that the no guest policy rules are enforced on main campus with there being key checks and stuff, but on West Campus are there there same checks? I know that Dons can check if there's noise and stuff, but do you actually need to show proof of keys or student ID to get into the building?
